AWESOME NETWORK POLICY

Definitions

  1. “Awesome Business Network (ABN)” means a directory of business services within Awesome Treasures Foundation (ATF) and may also be referred to as the “Network”;
  1. “Subscriber or You” means an active Volunteer or Partner of the Awesome Treasures Foundation who is listed on the ABN;
  • “An active Volunteer or Partner of the Awesome Treasures Foundation” means a volunteer who currently volunteers in an ATF unit or a partner who is consistent with his/her Partnership Obligations;
  1. “ATF Partner or Volunteer rights” means access to rights as listed in awesometreasuresfoundation.org/partner/ and https://awesometreasuresfoundation.co.uk/volunteer/

NOTE: By registering for and/or using, ABN including but not limited to visiting or browsing the Network, You consequentially agree to all the terms and conditions contained herein.

Subscribers’ Terms and Conditions

  1. Preliminary Conditions

1.1  ATF does not in any way benefit from any business listed on the ABN.

1.2  The ABN is a free platform offered to Partners and Volunteers of the ATF.

  1. Eligibility

To be listed on the Network, you must be an active Volunteer or Partner of the ATF.

  1. Responsibility

You are solely responsible for all of your activities with customers who patronize your businesses which are listed on the Network, and you are required to do your due diligence prior to transacting such businesses.

  1. Content:  
    • Persons or businesses listed on the Network shall be responsible for the content associated with their business listings on the Network
    • Content such as Business name and Registration number uploaded by a Subscriber on the ABN platform cannot be withdrawn or edited without the written permission of the authorized representatives of ATF.
    • Persons or businesses listed on the Network shall assume all risks associated with their content, including any customer’s reliance on the quality, accuracy, or reliability of the content uploaded, and any risks associated with the personal information disclosed.

4.4 You warrant and represent that you own or have the necessary permissions to use and or to authorize the use of your content as described.

4.5 To list your Business on the directory, you may post business related content that will be deemed suitable by ATF. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of content. ATF reserves the right to remove any content it deems unsuitable

  1. Regulation.

5.1 You agree to abide by all applicable local, state, national, and international laws/regulations relating to your business listed on the Network.

5.2 Also, if you represent a business, you agree to abide by all applicable laws relating to advertising, marketing, privacy, or other self-regulatory code(s) applicable to your industry.

  1. 6. Network Availability. 

The Network may be modified, updated, interrupted, suspended or discontinued at any time without notice or liability.

  1. 7. Customer Reviews.

You understand and acknowledge that your listing on the Network allows customers to post content about your Business, including photos, ratings, and reviews on other media.

  1. 8. Complaints

Complaints from Customers may be submitted to the authorized ATF representatives, who may at their discretion delist the business or withdraw the rights of the ATF Partner or Volunteer under reference.

  1. No Partnership.

These Terms and Conditions shall not be interpreted or construed to create an association, joint venture, agency relationship, or partnership between the Subscriber and ATF or to impose any partnership obligation or partnership liability upon either the Subscriber or ATF. The Subscriber shall not have any right, power, or authority to enter into any agreement or undertaking for or act on behalf of, or to act as or be an agent or representative of, or to otherwise bind ATF.

  1. Dispute Resolution.

If a dispute arises out of, or in connection with these Terms and Conditions, the Subscriber and the Customer agree to use their best endeavors to reach an amicable settlement of the dispute, failing which they shall resort to Mediation by a panel set up by ATF.

  1. Amendment / Termination-

11.1 Awesome Treasures Foundation may amend these terms and conditions, with or without notice.

11.2     Delisting of businesses and removal of subscribers are at the discretion of the of the Awesome Treasures Foundation.

11.3     If you wish to remove your Business listing from the Network, you can do so by sending a mail to abn@awesometreasuresfoundation.org

  1. Awesome Treasures Foundation Code of Conduct (the “Code”)

You are required to adhere to the Code when dealing with other partners, participants at ATF programs, government officials, suppliers, the public and any other stakeholder(s) in general. You are required to adhere to the Code when dealing with Customers or other Subscribers.

12.1  LEADERSHIP

Be the model of accountability and leadership and provide the example of ownership and stewardship that everyone can follow to success. Treat everyone fairly, respectfully and equally while holding everyone accountable to the same set of standards.

12.2  INTEGRITY

Act with integrity in the marketplace always and in all circumstances. Act honestly and fairly in your dealings with others, communicate accurately and clearly without misrepresentation.  Give due credit to originators of ideas or quotations that you contribute or utilize in communication and do not present material of others as your own.

12.3  COMMUNICATIONS

Be truthful and clear in your verbal and written communications and not be intentionally misleading to potential partners and stakeholders.

12.4 CONFIDENTIALITY

12.4.1  You are required to safeguard information entrusted to you as a partner and/or volunteer.

12.4.2  Where it is necessary to divulge confidential information, you are required to seek permission for this disclosure from the authorized ATF representative before doing so as you shall be liable for any alterations made via your account that was not supported by ATF.

12.4.3  ATF reserves the right at all times to disclose any information as necessary to satisfy any law, regulation or government request, or to edit, refuse to post or to remove any information or materials, in whole or in part, that in ATF’s sole discretion, are objectionable or in violation of these Terms and Conditions, or ATF policies.

12.5  PRIVACY

You consent to the collection and use of your personal and business information by ATF and it’s partners.

12.6  USER CONDUCT

You warrant that your use of the network is and will be in accordance with all applicable laws and regulations. You agree:

12.6.1  not to use the Network for illegal or immoral purposes;

12.6.2  not to interfere or disrupt other businesses listed on the Network;

12.6.3  to abide by all rules, guidance, terms and conditions as listed in these User Terms and Conditions and on the Network; and

12.6.4 not to transmit through the Network any unlawful, harassing, libelous, threatening, harmful, vulgar, obscene or otherwise objectionable material or communication of any kind or nature whatever.

12.7  INTELLECTUAL PROPERTY RIGHTS AND COPYRIGHT

12.7.1  ATF owns, solely and exclusively, all rights, title and interest in and to its information on the ABN Platform. This includes but is not limited to all the content (including, for example, audio, images, photographs, illustration, text, graphics, logos, button icons, other visuals, video, copy, etc.), software, access code, data and materials thereon, the look and feel, design and organization of the ABN  Platform, including but not limited to any copyrights, trademark rights, patent rights, database rights, trade secret, moral rights (including the rights of authorship and attribution and subsequent modification), sui generis rights and other intellectual property and proprietary rights (whether registered or unregistered in any jurisdiction) therein.

12.7.2 Your use of the ABN Platform does not grant you ownership of any of ATF’s content, software, code, data, or materials you may access on the ABN Platform.

12.8  COMPLIANCE

Partners and Volunteers would be expected to abide by the code of conduct and all other guidelines and policies set forth by ATF for the execution of its mandate in raising exceptional leaders.

12.9  PROFESSIONAL STANDARDS AND PERFORMANCE

All Partners and Volunteers are expected to promote high standards of practice and performance, to raise ATF’s professional output and increase its performance and effectiveness.

18. Exclusion of Liability

ATF is excluded from liabilities including but not limited to tortious liability resulting from any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft, or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, negligence, or under any other cause of action in respect of these terms and conditions

19. Indemnification

The subscriber/customer shall indemnify, and hold harmless ATF, its subsidiaries, affiliates, and each of its subsidiaries’, directors, and representatives from all losses, costs, actions, claims, damages, expenses (including legal costs) or liabilities, that arise from or relating to these terms and conditions, including but not limited to the businesses/subscribers listed on the Network and or the use or misuse of the information/content listed on the Network.
